Wessels Sherman Offers a New Service to its Clients – Early Mediation of Internal Workplace Disputes!

Our clients and friends are familiar with many of our firm’s client services, including our skilled litigation team they rely on to handle every sort of workplace litigation when things go bad. Many people also know about our one-of-a-kind phone consultation program, started in the 1980s to help employers avoid workplace issues from winding up in court. Our firm was on the forefront in keeping businesses out of legal trouble by allowing owners and HR professionals early access to advice from our experienced attorneys, without worries about incurring legal fees. We’re at it again – offering our clients yet another completely different service to deal with some of their toughest employment problems, potentially solving them before they mushroom into more serious problems.

James Sherman, our firm’s President/CEO, has undergone rigorous training in cutting-edge “transformative mediation.” In addition to becoming a qualified mediator under MN Rule 114, Mr. Sherman relies on his years of experience representing management in labor and employment disputes across the country. What makes this particular service – Early Transformative Mediation – so valuable to employers, is that it can take place before parties “lawyer up” to pursue formal grievances, charges, or litigate their dispute in court.

Here are just a few examples of situations where early transformative mediation might avoid an internal disputes hurting morale, productivity, or an employer’s image:

  • An informal grievance is raised between co-workers and while management believes it has dealt with the situation, for whatever reason one or more of the individuals involved won’t drop it and move on.
  • An otherwise good employee resists his or her supervisor’s or manager’s instructions to the point where the only recourse seems to be to discharge the employee for insubordination.
  • Two or more individuals constantly argue with one another, seemingly over virtually anything; you suspect that there may be a bias involved but there is nothing tangible to confirm your suspicion.

Transformative mediation, done confidentially and in a manner designed to allow each party to gain a greater understanding of the other’s point of view, without judgement, can give parties to a dispute, an opportunity to resolve their issues themselves (versus being pushed toward the customary compromise associated with most mediation). When individuals resolve their dispute themselves, the solution can be long-lasting and result in greater job satisfaction.

These are not the sort of marathon sessions many come to associate with mediation. A typical early transformative mediation session will last 1-2 hours. Compared to the high cost of turnover, lost productivity for disgruntled workers and/or supervisors and managers alike (or worse, litigation), early transformative mediation can be a bargain. Dick Wessels’ Client Visits and Restaurant Tips

Client visits: You may have heard that our firm’s founder, Dick Wessels, since 1985 has had a practice of paying a short visit to clients and friends of Wessels Sherman. His deep conviction is that it is important to actually visit the place of business to get a feel of what they are all about. Dick has never wavered in this belief. He knows how busy managers are so he never stays longer than 10 minutes. Dick regularly says he will leave mid-sentence if it goes into the 11th minute.

Restaurant tips: Because of his years of such Chicago area travels, Dick has a list of his top quick places for lunch. Wessels Sherman’s 2017 Employer Empowerment Seminar in Minnesota is Another Big Success!

Wessels Sherman’s Minnesota office hosted the firm’s annual labor and employment law seminar for employers, accountants, attorneys and other business professionals on April 28, 2017 at the beautiful Radisson Blu, Mall of America hotel. James Sherman, firm President/CEO and Founder/Managing Shareholder of our Minneapolis office, welcomed the room full of attendees who came from four different states and a broad spectrum of industries and fields. After delivering the day’s first presentation on drastic changes taking place in workplace laws and regulations in 2017, Mr. Sherman served as moderator to introduce the many other presenters throughout the day. Special Guest Speaker Nick Rogers, President/CEO of Minnesota’s newest major league sports team (and a lawyer who previously practiced in the private sector), regaled the audience with the fascinating story behind Minnesota United’s mercurial rise from the lower division league, to one of the countries two MLS expansion teams in 2017, to breaking ground on a brand new, privately financed, soccer specific stadium in May of this year. The club’s success story can be an inspiration to businesses of all sizes and industries!

Of course the firm’s attorneys from Minnesota, Wisconsin, Iowa and Illinois, provided attendees with current information and experienced advice on many of the biggest issues in human resources and workplace law, today. Based on feedback from those who attended the seminar, some of the most popular topics presented on included: EEOC guidance on pregnancy in the workplace; ADA accommodations for mental disabilities; intermittent FMLA leave; tips on employee handbooks; ACA update, among many others. In addition to the presentations and valuable materials, attendees received vouchers for free audits of company handbooks and Forms I-9, to help cope with the new administration’s promise of increased scrutiny in certain areas.

Allison Wells comes to Wessels Sherman from a highly regarded Twin Cities immigration law firm, where she focused her practice on representing employers in all aspects of employment-based immigration matters. Her extensive experience includes helping employers throughout much of the country with a broad spectrum of workplace immigration needs, including: EB-1 multinational managers, PERM Labor Certification/I-140, L-1A/B, H-1B, O-1, TN, B-1, H-2, family based petitions, waivers, naturalization, and U Visa. She also works with employers on I-9 and other compliance audits.

In addition to assisting the firm’s clients throughout the Midwest and beyond with immigration-related matters, Ms. Wells’ practice will include counseling and representing employers before state and federal courts and administrative agencies, on employment and labor matters. Ms. Wells holds a Bachelor of Arts degree with a double major in Spanish and Journalism, and a Master’s degree in Spanish Language and Literature from Marquette University. She graduated with honors from William Mitchell Law School and served as editor of the William Mitchell Law Raza Journal of Law and Diversity. Allison speaks fluent Spanish and resides in the Twin Cities area with her husband, Andy and daughter, Sloan. Please join us in welcoming Allison Wells to Wessels Sherman!
